1. About Lotey Travels
Lotey Travels is a licensed retail travel agency registered with the Travel Industry Council of Ontario (TICO).
Legal name: 1001333955 Ontario Corp. o/a Lotey Travels
Business address: 1 Royce Ave, Unit 3, Brampton, ON L6Y 1J4, Canada
TICO Registration Number: 5003109
These Terms & Conditions (“Terms”) govern the relationship between Lotey Travels (“we”, “us”, “our”) and clients (“you”, “your”) who purchase or inquire about travel services through our office, by phone, by email, or via our website loteytravels.com.
By requesting a quote, confirming a booking, or making any payment through Lotey Travels, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Our role as a travel agent
Lotey Travels acts as a travel agent and intermediary between you and travel service providers such as airlines, tour operators, cruise lines, hotels, car rental companies, insurance providers, and other suppliers (“Suppliers”)
- We sell travel services on behalf of these Suppliers and do not own, operate, or control the services they provide.
- All reservations are subject to the terms and conditions, rules, and policies of the relevant Supplier, which may limit or exclude their liability.
It is your responsibility to review applicable Supplier terms before completing your booking; our travel consultants can help obtain or explain these where requested.
3. Quotes and pricing
Currently, our website does not display live pricing for flights or packages. All prices are provided directly by our travel consultants via phone, email, or in person, based on real‑time availability at the time of quotation.
- Quotes are subject to change until payment is received and your booking is confirmed by the Supplier.
- The total price communicated to you by our consultants will include all applicable taxes, fees, and surcharges payable to the Supplier or to us at the time of booking, unless we clearly advise otherwise (for example, mandatory fees payable locally at destination).
- Any fees that are payable only at destination and not collected by Lotey Travels will be disclosed to you where applicable.
4. Booking process and confirmation
To proceed with a booking, you may be asked to provide:
- Full legal names (exactly as per passports or government ID)
- Dates of birth and contact details
- Passport information (for international travel)
- Any special requests or mobility needs
A booking is not confirmed until:
- You have agreed to the itinerary and price provided by our consultant.
- We have received the required payment (deposit or full payment, as advised).
- We have issued a confirmation showing your booking reference or ticket number, subject to Supplier confirmation.
You must carefully review all confirmations and documents (names, dates, destinations, times, spelling) and advise us immediately of any discrepancies.
5. Payments, deposits, and service fees
Payment requirements will be communicated to you at the time of booking and can vary by Supplier and product.
- Some bookings may require full payment at the time of booking.
- Others may allow an initial deposit with a specified final payment date; if final payment is not received by the deadline, the booking may be cancelled by the Supplier and any deposit may be non‑refundable.
We may charge service or counselling fees for certain services (such as ticketing, changes, cancellations, or after‑hours support). Any such fees will be disclosed to you before they are applied.
Payments can typically be made by credit card, debit, e‑transfer, or other methods as advised by your consultant. You authorize Lotey Travels to use your payment details to secure travel services with the relevant Suppliers.
6. Changes and cancellations by you
If you need to change or cancel your booking, you must contact Lotey Travels as soon as possible.
- Supplier rules: Many fares and packages are non‑refundable, non‑changeable, or subject to penalties; airline and tour operator terms will prevail.
- Change fees: Suppliers may charge change fees or fare differences; Lotey Travels may also charge an additional agency service fee for processing changes.
- Cancellation fees: If you cancel, you may forfeit some or all of the amounts paid, depending on the applicable Supplier policies and timing of your request.
All change or cancellation requests must be made during our business hours and are considered received only once we have acknowledged them.
7. Changes and cancellations by suppliers
Suppliers may modify or cancel flights, packages, accommodations, or other components due to reasons such as schedule changes, overbooking, operational issues, or events beyond their control (e.g., weather, strikes, political events, health emergencies).
- Where a Supplier cancels or significantly changes your booking, their policies will determine your options (e.g., rebooking, credits, or refunds, if available).
- Lotey Travels will assist you in communicating with Suppliers and understanding the options presented but is not responsible for decisions made by Suppliers or for any additional costs you may incur as a result.
8. Refunds
Refund eligibility is strictly governed by Supplier rules.
- Some fares and products are completely non‑refundable, while others may be partially refundable with fees deducted.
- Where a refund is authorized, it will be processed back to the original form of payment when possible.
- Agency service fees, if charged, may be non‑refundable, even if the underlying travel service is refunded.
Refund processing times vary by Supplier and can take several weeks or longer; Lotey Travels has no control over these timelines.
9. Travel documents and entry requirements
For international travel, you are responsible for ensuring that you and anyone in your party meet all entry, exit, and transit requirements for each destination, including:
- Valid passport with sufficient validity
- Visas, e‑visas, or electronic travel authorizations
- Any required vaccinations, health certificates, or other documentation
Our consultants can provide general information and references to official resources, but we do not guarantee the completeness or accuracy of immigration or health requirements, which can change without notice.
Failure to present proper documents or to comply with government requirements may result in denied boarding or entry, travel interruption, and additional costs at your expense.
10. Travel insurance
Lotey Travels strongly recommends that you purchase adequate travel insurance, which may include coverage for:
- Trip cancellation and interruption
- Emergency medical and hospital expenses
- Baggage loss, delay, or damage
- Flight or travel accident
Our consultants can provide information on available insurance products; it is your responsibility to review the coverage, limitations, and exclusions and to select a policy that meets your needs.
Refusal or failure to purchase insurance is entirely at your own risk.
11. Limitation of liability
To the fullest extent permitted by law:
- Lotey Travels is not liable for any loss, damage, injury, delay, inconvenience, or expense arising from acts, errors, or omissions of Suppliers or any third parties.
- We are not responsible for any losses arising from events beyond our reasonable control, including force majeure events such as natural disasters, pandemics, government actions, strikes, or technical failures.
- Our liability, if any, in connection with any services shall be limited to the amount of commissions or service fees earned by Lotey Travels for the specific booking in question, unless otherwise required by applicable law.
Nothing in these Terms limits any rights you may have under the Travel Industry Act, 2002, its Regulation, or other consumer protection laws in Ontario.
12. Complaints, TICO, and compensation fund
