1. About Lotey Travels

Lotey Travels is a licensed retail travel agency registered with the Travel Industry Council of Ontario (TICO).

These Booking Terms & Policies (“Booking Terms”) apply to all travel inquiries and reservations made with Lotey Travels (“we”, “us”, “our”) by phone, email, in person, or through our website loteytravels.com. By confirming a booking or making any payment, you agree to be bound by these Booking Terms.

2. Our role as your travel agent

Lotey Travels acts as an intermediary between you and travel service providers, including airlines, tour operators, cruise lines, hotels, car rental companies, insurance providers, and other suppliers (“Suppliers”).

  • We arrange travel services on your behalf; we do not own or operate the services provided by Suppliers.
  • Your travel arrangements are governed by the terms and conditions, rules, and policies of each Supplier, which may limit or exclude their liability.

Our consultants will help explain Supplier conditions upon request, but it is your responsibility to review and understand them before completing your booking.

3. Quotes and availability

Our website does not display live pricing at this time. All prices are provided directly by our travel consultants based on real‑time availability at the time of quotation.

  • Quotes are subject to change and cannot be guaranteed until payment has been received and the booking is confirmed by the Supplier.
  • Fares and availability may change without prior notice due to airline or Supplier rules.
  • The total cost communicated to you will include all applicable taxes, fees, and surcharges payable at the time of booking, unless we clearly specify charges that are only payable at destination (for example, local resort fees or city taxes).

4. Booking process

To proceed with a booking, you must provide accurate and complete information for all travelers, including:

  • Full legal names exactly as shown on passports or government‑issued ID
  • Dates of birth
  • Contact details (phone number, email address)
  • Passport information and expiry dates (for international travel)
  • Any special requests, medical conditions, or mobility needs (subject to Supplier availability)

A booking is considered confirmed only when:

  1. You have accepted the itinerary and price provided by our consultant.
  2. We have received the required payment (deposit or full amount, as applicable).
  3. We have issued a confirmation detailing your booking reference or ticket number, subject to Supplier confirmation.

You must carefully review all confirmations and travel documents and notify us immediately of any errors or discrepancies.

5. Payments, deposits, and service fees

Payment terms vary depending on the Supplier and type of travel service.

  • Some bookings may require full payment at the time of booking.
  • Others may allow an initial deposit with a specified final payment deadline. If final payment is not received by the deadline, your booking may be cancelled by the Supplier and any deposit may be non‑refundable

Lotey Travels may charge agency service or counselling fees for certain services such as ticket issuance, changes, cancellations, or after‑hours assistance. Any such fees will be disclosed before being applied.

By providing payment information, you authorize Lotey Travels to use those details to secure travel services with Suppliers and to collect any applicable service fees.

6. Changes and cancellations requested by you

If you need to change or cancel your booking, you must contact Lotey Travels as soon as possible.

  • Supplier rules: Many airfares, promotional rates, and package components are non‑refundable or non‑changeable, or may be subject to strict penalties. Supplier terms will always prevail
  • Change fees: You may be charged Supplier change fees and fare differences; Lotey Travels may also charge an additional agency service fee for processing changes.
  • Cancellation fees: If you cancel, you may lose all or part of the amounts paid, depending on timing and Supplier rules

Requests are considered received only when acknowledged by Lotey Travels during normal business hours. Changes or cancellations cannot be guaranteed until confirmed by the Supplier in writing.

7. Changes and cancellations by suppliers

Suppliers may modify or cancel flights, schedules, accommodations, or other services for reasons such as schedule changes, overbooking, operational requirements, safety concerns, weather, natural disasters, strikes, public health events, or other circumstances beyond our control.

  • In such cases, the options available to you (e.g., rebooking, credits, or refunds where applicable) are determined by the Supplier’s policies.
  • Lotey Travels will assist you in communicating with Suppliers and understanding the options offered, but we are not responsible for decisions made by Suppliers or for additional costs (e.g., extra nights, meals, transportation) arising from such changes.

8. Refunds

Refunds are governed by the applicable Supplier rules and fare conditions.

  • Some products are completely non‑refundable, while others may allow partial refunds with penalties deducted.
  • Service or counselling fees charged by Lotey Travels may be non‑refundable, even if the underlying travel service is refunded.
  • Where a refund is due, it will generally be credited to the original form of payment. Refund timelines vary by Supplier and are outside the control of Lotey Travels.

9. Travel documents and entry requirements

You are responsible for ensuring that you and any accompanying travelers meet all entry, exit, and transit requirements for each destination, including but not limited to:

  • Valid passports with sufficient validity and blank pages
  • Visas, e‑visas, or electronic travel authorizations
  • Any mandatory vaccinations, health certificates, or testing requirements

Our consultants can provide general guidance and links to official resources, but immigration, customs, and health regulations can change at any time, and we do not guarantee the completeness or accuracy of this information.

If you are denied boarding, refused entry, or otherwise affected due to incomplete or incorrect documentation, all resulting costs are solely your responsibility.

10. Travel insurance

Lotey Travels strongly recommends that you purchase comprehensive travel insurance to protect against unforeseen events such as:

  • Trip cancellation or interruption
  • Emergency medical and hospital expenses
  • Baggage loss, damage, or delay
  • Flight or travel accidents

Our team can provide information on available insurance options, but it is your responsibility to review policy wording, coverage limits, exclusions, and conditions to ensure the chosen plan meets your needs.

Declining travel insurance is entirely at your own risk.

11. Limitation of liability

To the maximum extent permitted by law:

  • Lotey Travels is not liable for any personal injury, sickness, loss, damage, delay, inconvenience, or expense arising from acts or omissions of Suppliers or any third parties.
  • We are not responsible for any losses or additional costs resulting from events beyond our reasonable control, including but not limited to force majeure events such as natural disasters, pandemics, government actions, strikes, or technical failures.

These Booking Terms do not limit any rights you may have under the Travel Industry Act, 2002, Ontario Regulation 26/05, or other applicable consumer protection legislation.

12. Complaints, TICO, and compensation fund

If you have a concern about services provided by Lotey Travels, please contact us first so we can attempt to resolve the issue informally and promptly.

Lotey Travels is regulated by TICO. In certain circumstances, eligible consumers who purchase from a TICO‑registered travel agency may have access to the Ontario Travel Industry Compensation Fund.

13. Privacy

We collect and use personal information only as needed to:

  • Provide travel services and manage your bookings
  • Communicate with you regarding your travel arrangements
  • Comply with legal, regulatory, and security obligations

We may disclose personal information to Suppliers, insurance providers, payment processors, and other third parties directly involved in arranging your travel. By booking with us, you consent to these uses and disclosures.

14. Governing law

These Booking Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising out of or relating to services provided by Lotey Travels shall be subject to the exclusive jurisdiction of the courts of Ontario.
